1. General
1.1. The terms of use of the online store (hereinafter the Terms of Use) govern the use of the online store located at the internet address www.apsoon.ee and its subpages (hereinafter the Web Store) and the terms of sale of the vinyl records (hereinafter the Shop) sold through it.
1.2. The online store is owned and managed by APSoon OÜ (hereinafter APSoon), address Järva county, Paide county, Paide city, Tööstuse tn 17, 72720, business register code 16523964, e-mail: dsd@apsoon.com, telephone (+372) 5377 2176
1.3. The customer can purchase the goods offered in the online store both as a registered customer and as a guest. All natural and legal persons of legal age can be clients.
1.4. The registered customer is responsible for the actions of all persons who use the Online Store using the username and passwords given to them, including the consequences of all actions taken and damage caused.
1.5. The Terms of Use of the Online Store apply to all persons who use the Online Store, and by using the Online Store, the person confirms that he has accepted the Terms of Use and undertakes to comply with them.
1.6. When placing an order, the customer confirms that all the information provided by him is correct, he is a fully capable natural person and, acting as a representative, he has all the rights and authorizations to purchase the Goods on behalf of the customer. The correctness of the confirmations of the client and the client’s representative is assumed and APSoon is not obliged to verify it.
1.7. The price of the Goods offered in the online store is given in euros. All prices in the Online Store include VAT.
1.8. APSoon may change, supplement, replace or delete the Terms of Use and the price of the Goods offered in the Online Store, terms of sale and other information at any time at its discretion.
1.9. Changes and additions to the Terms of Use, the price of the Goods and other information take effect from the moment the changes are made in the Online Store. If the customer submitted his order before the change came into effect, the conditions valid at the time of submitting the order apply to him.
2. Forming the order, payment for the goods and transport
2.1. To purchase goods from the Online Store, the customer must select a vinyl record and add it to the shopping cart (hereinafter Shopping Cart). Each vinyl record has a description of the record and the possibility to listen to one sample track.
2.2. The customer’s shopping cart is created the moment he has added the Product to the shopping cart. Adding a product to the shopping cart does not obligate the customer to purchase.
2.3. The customer can change the amount of goods in the shopping cart and remove them from the shopping cart if necessary.
2.4. The Goods in the shopping cart are also available to other customers until the purchase is confirmed.
2.5. To make a purchase, the customer must select the Itella Smartpost parcel terminal where the customer wants to receive the Product and the payment method. You can pay for your purchase with a bank link, debit/credit card, Every Pay payment module or another payment solution offered by APSoon.
2.6. After completing the purchase, an order confirmation is automatically sent to the customer’s e-mail address.
2.7. With Itella Smartpost, the customer can order Goods to Estonia, Latvia, Lithuania and Finland. For shipping to other countries, the customer must contact APSoon at dsd@apsoon.com and request a shipping quote.
2.8. APSoon will deliver the Goods to the customer no later than 1 week after confirming the order.
3. Canceling the order, returning the goods
3.1. The consumer has the right to return the Goods to APSoon within 14 days of receiving the Goods. The customer has the right to return only unopened Goods.
3.2. If the customer wishes to return the Goods, a corresponding request must be sent to the e-mail address dsd@apsoon.com with his/her data and current account number.
3.3. In case of returning the goods, the customer returns the goods to APSoon without delay, but no later than within 15 days of making the corresponding request. Returned Goods must be unused and in their original sealed packaging.
3.4. APSoon transfers the money for the returned Goods back to the customer’s current account as soon as possible, but no later than within 15 days of receiving the returned Goods. The costs related to the return of the goods are borne by the customer.
4. Non-compliance of the goods with the conditions of sale
4.1. APSoon is responsible for non-compliance with the terms of sale of the Goods sold to the customer, which existed at the time of handover of the Goods to the customer and which appear within two years from the handover of the Goods. APSoon is not responsible for defects that have occurred after the delivery of the Goods.
4.2. In case of non-compliance of the goods with the conditions of sale, the customer must submit a claim to the e-mail address dsd@apsoon.com, and in the claim, the customer’s name, contact telephone number, order number and a precise description of the non-compliance of the goods with the conditions must be indicated. The customer has the right to contact APSoon no later than 1 month after the defect has appeared. APSoon reviews the claims and responds to the customer as soon as possible, but no later than within 15 days from the receipt of the claim.
4.3. APSoon must be notified of transport damage within 1 week of receiving the Goods.
5. Principles of processing the client’s personal data
The principles of personal data processing of a natural person customer are described in the privacy policy of the Online Store.
6. Copyrights
6.1. All information contained in the Online Store, including the design and software of the Online Store, is protected by copyright in accordance with the Copyright Act. All copyrights to the materials presented in the Online Store belong to APSoon or have been granted to APSoon to the extent that allows their use in the Online Store.
6.2. The information contained in the online store can only be used for non-commercial purposes, and copying, reproducing, distributing and otherwise transferring the information contained in it to third parties without the prior written permission of APSoon is prohibited.
7. Information that the Online Store stores (cookies)
7.1. APSoon uses cookies in the Online Store to ensure a better user experience, usage statistics, security and more effective marketing activities.
7.2. Cookies are small text files that are stored in the memory of the client’s device by the visited internet pages. There are session cookies (temporary cookies), the purpose of which is to enable the use of the service, and permanent cookies (saved on the customer’s computer after closing the web browser), the purpose of which is to remember the customer’s choices in the Online Store.
7.3. APSoon uses the following cookies:
– analytical cookies that collect information about how the Online Store is used, e.g. which content pages are visited the most or what visitors search for in the Online Store, etc. These cookies do not collect information that could directly identify the customer of the Webshop. This includes, for example, Google Analytics cookies.
– advertising cookies that help to offer advertisements targeted to the customer’s interests. For example, the Facebook Pixel, which allows you to see the Online Store’s ad on Facebook.
7.4. APSoon collects the statistical data of the Online Store in the Google Firebase (analytics.google.com) environment for statistical analysis, and the conditions of the respective environment also apply to the collection and storage of data.
7.5. The customer can disable the use of cookies in the settings of his web browser or delete them, but in this case, APSoon cannot guarantee the correct functioning of the Online Store.
8. Other Terms
8.1. All notices and information are sent from APSoon to the customer in electronic form to the e-mail address entered by the customer when registering a user account or placing an order.
8.2. All notices and information are sent from the customer to APSoon through the e-mail address provided in the Online Store or Terms of Use.
8.3. The customer undertakes to compensate APSoon for direct property damage, which is accompanied by a violation of the Terms of Use by the customer.
8.4. The customer has the right to withdraw from the Terms of Use at any time, i.e. cancel the contract between APSoon and the customer.
8.5. The agreement ends automatically with the deletion of the customer’s user account, but does not release the parties from the obligations arising from the agreement.
8.6. The law applicable in the Republic of Estonia applies to the contract.
8.7. The client and APSoon will try to resolve disputes arising from the contract through negotiations. If no agreement is reached, the dispute will be resolved in the court of the defendant’s place of residence or location.
8.8. If it is not possible to resolve the disputes through negotiations, the consumer client can also turn to the Consumer Protection and Technical Supervisory Board (location Endla 10A, 10122 Tallinn, www.ttja.ee) for advice and clarification, or submit the dispute to the Consumer Disputes Committee. A complaint can also be submitted to the Consumer Disputes Commission through the online dispute resolution environment at http://ec.europa.eu/odr, the commission’s procedural rules can be found at www.ttja.ee.
